Company Secretaries June, 2012 Examination -Applicability of the latest Finance Act and other changes


ATTENTION STUDENTS!

Applicability of the latest Finance Act and other changes for Company Secretaries June, 2012 Examination.

DIRECT TAXES

All students may note that for the June 2012 Examination Session in respect of Direct Taxes the applicable Assessment Year shall be 2012-13 (Previous Year 2011-12). Thus, they will have to study Finance Act, 2011 for June 2012 Examination. Further as per the Syllabus, (of Executive Programme and Professional Programme) students are required to update themselves about all the Circulars, Clarifications, Notifications, etc., issued by the CBDT & Central Government, which come into effect on or before six months prior to the date of the respective examinations.
Gift Tax Act has been excluded from the scope of the examination from June 1999 session onwards unless otherwise informed.

INDIRECT TAXES

Students appearing in the ‘Tax Laws’ (Indirect Tax Portion to the extent of topics covered in the syllabus, of ‘Executive Programme’) and Advanced Tax Laws and Practice (Professional Programme) respectively may take note of the following changes applicable for June 2012 Examination.
1. All changes made by the Finance Act, 2011.
2. All Circulars, Clarifications/Notifications issued by CBEC / Central Government which became effective six months prior to the date of examination.

SIMPLE TIPS TO GET MORE MARKS IN CS EXAMS

Before You Start & Before You Conclude Each Answer

Before You Start - Write a Heading to each answer.

EXAMPLE 1: If the question is “What are the provisions to be compiled with in Buy-Back of Securities, in the case of a listed company?”

The model heading should be:

ANSWER TO Qs. No……

BUY-BACK OF SECURITIES – LISTED COMPANIES – PROVISIONS TO BE COMPLIED WITH – SECTION 77A OF COMPANIES ACT 1956 AND SEBI (BUY-BACK OF SECURITIES) REGULATIONS


EXAMPLE 2: If the question is “What do you mean by an interested director ?”


The model heading should be:


ANSWER TO Qs. No……


INTERESTED DIRECTOR – SECTION 297, SECTION 299 AND SECTION 300 OF COMPANIES ACT 1956


Before You Conclude - Give a nice conclusion to each answer.


EXAMPLE 1: If the question is “What do you mean by repatriate to India under the FEMA 1999?”


After you answer write the following conclusion paragraph:

Thus, repatriate to India means bringing into India the proceeds from outside India, and this is dealt with by Section 2(y), Section 8 and Section 9 of FEMA 1999.
